Eli Lilly and Company Reaches Global Settlement Over Testosterone Drug

CHICAGO, Ill. — Eli Lilly and Company reached a global settlement for hundreds of lawsuits over its testosterone replacement therapy drug Axiron.

The lawsuits brought against the company cited that those who used Axiron had major medical complications including heart attack, stroke, blood clots, and sudden death.

Although the company has reached a settlement, it is important to note that if you or a loved one has suffered complications due to Axiron or another Testosterone drug, you can still file a lawsuit and get the justice you deserve.

Recent medical studies have identified a number of potential risks or complications from the use of testosterone replacement therapy, including the risk of:

  • Heart Attack (Myocardial Infarction)
  • Ischemic Stroke
  • Hemorrhagic Stroke
  • Stroke
  • Deep Vein Thrombosis (DVT)
  • Pulmonary Embolism (PE)
  • Blood clots
  • Death

Are Other Testosterone Drugs Under Litigation?

Eli Lily’s Axiron is not the only drug that has faced major litigation. AbbVie’s AndroGel has already lost two trials awarding over $140 million to those who suffered medical complications.

FDA-approved formulations include topical gel, transdermal patch, buccal system (applied to upper gum or inner cheek), and injection. Other drugs listed below have had their side effects challenged in court:

Brand Type Manufacturer
Androderm Patch Actavis
Axiron Topical Solution Eli Lilly
Bio-T-Gel Topical Gel Teva
Delatestryl Topical Solution, Injection Indevus
Depo-Testosterone Topical Solution, Injection Pfizer
Fortesta Topical Gel Endo

Testim Topical Gel Auxilium
Testopel Subcutaneous Pellet Endo

Testosterone Lawsuit Allegations

Among the many different low testosterone treatments that are facing litigation, the main accusations include:

  • Misrepresentation of the safety of the drug: Advertisements downplay the risks associated and the complications patients reported
  • Exaggerating the benefits of the drug: Certain companies have omitted or failed to adequately warn patients and physicians about the risks and how often the patient requires monitoring to ensure safety.
  • Engaging in ‘Disease Mongering”: This is defined as the widening the diagnostic boundaries of illnesses to increase sales and expand the markets for the drug.

Disease Mongering?

The marketing tactics involved with companies like Eli Lilly and others have been brought into question. Many cases state that the companies are widening the diagnostic boundaries of illnesses to increase sales and expand into other markets for the drug.

Drugmakers have often marketed unproven uses for their products piggybacking on already existing FDA approvals. It is said that the ‘Low T’ drugs are being marketed as the new Viagra, often misleading patients to ask their doctors about testosterone replacement drugs. In drugmakers doing so, they have increased the market to an evaluation of nearly $1.6 billion dollars. Attorneys and plaintiffs alike cite the greed to get the market to where it is today left consumers without knowing all of the risks associated with the drugs.

Other Testosterone Verdicts

AbbVie Inc. was the first testosterone drug manufacturer to be brought before the court. The first four cases, also known as the Bellwether Trails, involve plaintiffs who claim the drug AndroGel caused both heart attacks, strokes, and blood clot injuries to the patients. These trials proved to be successful to the plaintiffs and in June and July 2017, AbbVie was ordered to pay out two separate settlements of $140 million and $150 million respectively.

In the July 2017 case, the attorneys for the plaintiff were not able to prove AndroGel was the cause of their plaintiff’s heart attack, however, the jury still found the company liable for false marketing, or fraudulent misrepresentation leading to the $150 million dollar settlement.
