Federal Court Backed Up With Almost 1400 Testosterone Cases

According to a report published by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on April 15th, 2015, there are now 1,382 testosterone lawsuits pending in federal court. This is an increase of more than 200 cases within the last month. The cases have been consolidated in a multidistrict litigation action in the North District of Illinois since June of 2014, and lawsuits have continued to rise, especially in recent months following the United States Food and Drug Administration’s requirement that all testosterone labels be marked with a clear warning regarding the serious side effects that have been associated with the drug.

The lawsuits concern testosterone replacement therapy drugs such as Androgel, which are used to combat low levels of testosterone. Although hypogonadism, the medical term for low testosterone levels, is a medical concern and a valid reason for obtaining testosterone replacement therapy, the number of prescriptions for low-T supplements has increased dramatically in recent years, and many men receive testosterone replacement drugs without being diagnosed with hypogonadism at all. This rise appears to be due to increases in advertising that target middle-aged men and tout testosterone replacement as a solution for what would generally be considered average signs of aging such as lower energy levels, difficulties sleeping and decreased sex drive. According to a an article recently published in The Journal of the American Geriatrics Society, titled  “Disease Mongering of Age-Associated Declines in Testosterone and Growth Hormone Levels,” testosterone replacement therapy prescriptions have increased dramatically in the last decade due of the prevalence of advertising directly to potential patients, as well as a lack of strict guidelines for testosterone prescription.

Although the FDA has approved the prescription of testosterone replacement therapies, this approval is limited to patients with hypogonadism or abnormally low levels of testosterone. Despite these requirements, only about 25% of men who are currently prescribed testosterone supplements have even been tested for hypogonadism, much less diagnosed with it. Many men seek out the drug to combat low energy levels or decreased sex drive. However,  there still have not been any conclusive studies linking testosterone replacement therapy with reversal of the effects of aging. On the contrary, studies have linked the use of testosterone by men who do not have hypogonadism to increased risk of blood clots and heart attacks.
