Judge Denies Testosterone Lawsuit Dismissal

A U.S. district judge last month refused testosterone producers’ motion to dismiss 39 lawsuits alleging complications arising from use of their supplements. There were several testosterone supplements named in the lawsuits, including Androderm, AndroGel, and Testim. These products, although approved by the FDA for treating low testosterone levels, have been known to cause severe side effects in some users and have brought about many lawsuits.

These 39 lawsuits were consolidated by the U.S. Judicial Panel on Multidistrict Litigation because they alleged similar injuries resulting from the use of the supplements. Some of these complications include cardiac problems, blood clots/DVT, and strokes or fatal complications. To increase the efficiency for both sides, all lawsuits regardless of the manufacturer will be consolidated. There are hundreds of lawsuits currently pending. Other products facing litigation include Delatestryl, Fortesta, Axiron, and Depo-Testosterone.

The motion to dismiss the lawsuits claimed that the injuries resulted from the drugs were not plausible and that the studies the cases relied on were found to be untrue. In June 2014, the FDA mandated that testosterone supplements must include additional warnings on their labels due to the recent studies linking the severe side-effects to the products. Some of these studies suggest that the supplements increase the risk of cardiac episodes, especially if over the age of 65. Specifically, the FDA acknowledged the suspected link between the use of testosterone supplements and the increased risk of blood clots and deep vein thrombosis. These studies were cited by the judge when denying the motion to dismiss.
